2. Definitions
- Account: Your account with us that provides access to the VPS or Dedicated Server.
- Content: Any data, information, applications, software, or other materials you upload to or store on the VPS or Dedicated Server.
- Service Level Agreement (SLA): An optional agreement outlining guaranteed uptime or performance metrics for our services.
- Uptime: The percentage of time the VPS or Dedicated Server is accessible over a specific period.
3. Services
We provide VPS and Dedicated Server hosting services. VPS offers a virtualized environment on a shared physical server, while Dedicated Servers provide exclusive access to an entire physical server.
We reserve the right to modify our service offerings at any time.
4. Your Responsibilities
- You are responsible for the security and confidentiality of your account credentials.
- You are responsible for all content uploaded to or stored on the VPS or Dedicated Server.
- Complying with the AUP.
- You are responsible for complying with all applicable laws and regulations in your use of the services.
- You agree to use the services in a manner that does not interfere with the use of our services by others.
- You agree not to engage in any activities that could damage or disrupt our network or servers.
5. Acceptable Use Policy
You agree to not use the Services for any activity that:
- Is illegal or violates any applicable laws.
- Infringes on the intellectual property rights of others.
- Is harmful, abusive, or threatening.
- Overloads our servers with excessive resource usage.
We reserve the right to suspend or terminate your Service for violating the AUP.
6. Backups
We are not responsible for backing up your content. You are solely responsible for regularly backing up your content.
7. Uptime
We strive to provide high uptime for our services. We do guarantee 99.8% uptime. We may offer optional SLA agreements with guaranteed uptime metrics for an additional fee.
8. Payment
You agree to pay the fees for the services you select according to our pricing plans. We reserve the right to modify our pricing plans at any time.
9. Term and Termination
This Agreement remains in effect until terminated by you or us. You may terminate your account at any time. We may terminate your account for violation of this Agreement or for any other reason.
10. Limitation of Liability
We are not liable for any damages arising from your use of the services, including but not limited to, data loss, downtime, or business interruption.
11. Disclaimer of Warranties
We provide the services "as is" and without warranty of any kind, express or implied.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida in the USA.
13. Entire Agreement
This Agreement constitutes the entire agreement between you and us regarding the use of the services.
14. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
15. Changes to the Terms of Service
We reserve the right to modify this Agreement at any time. We will notify you of any changes by posting the revised Agreement on our website. Your continued use of the services after the revised Agreement is posted constitutes your acceptance of the revised Agreement.
